What is Age Discrimination?

The California Fair Employment and Housing Act (“FEHA”) makes it unlawful for California employers to discriminate against an employee because they are 40 years of age or older.

To prove age discrimination under California law, an employee must show that their employer took an adverse employment action against them because of their age. Such actions may include refusing to promote an employee or terminating their employment because of their age. However, because direct evidence of an employer’s motivation for making an adverse employment decision is seldom available, our Pasadena age discrimination attorneys often prove discrimination claims through circumstantial evidence.

Typically, an inference of age discrimination arises when it is shown that: (1) at the time of the adverse employment action, the employee was 40 years of age or older; (2) the adverse employment action was taken against the employee; (3) at the time of the adverse employment action the employee was satisfactorily performing their job, and (4) that the employee was replaced by a significantly younger worker.

Age-Based Harassment

In addition to discrimination, the FEHA prohibits harassment based on age. Age-based harassment occurs when an employer creates or allows an abusive, offensive, or intimidating work environment, which negatively impacts the employee’s ability to perform their job.

For example, age-based harassment often involves slurs, jokes, or derogatory remarks about a person’s age. These types of comments both support a claim for age discrimination and give rise to a separate claim for age harassment. Furthermore, unlike a discrimination claim, our Pasadena age discrimination attorneys can name the individual when bringing a claim for age-based harassment.

Our Age Discrimination Attorneys Can Help

Unfortunately, many workers over 40 years of age are subject to unlawful age-based discrimination or harassment at work. If your employer has mistreated you because of your age, we can help. Contact our office today for a free consultation with our Pasadena age discrimination attorneys.

Pregnancy Discrimination Trial Win
I never thought I would be involved in a lawsuit-much less for 6 years!! But I do feel qualified in the time I spent with Christa to call myself an expert regarding what it was like to work with her. My case was against a Police Department, and went to trial. Christa held my hand through it all-she was ALWAYS there to pick me up, dust me off and talk me UP. She helped make me strong. She was always a phone call or email away, explaining everything thoroughly. She worked tirelessly-always with my best interest at heart. And what a huge heart it is. She is very detail oriented and grasped the case better than I even thought was possible! I thought this case would never end, but now that it has-I will miss working with her! Thank you for winning WITH me. Thank you for being so very different, so authentically you!!

Very Positive Experience
I contacted Christa one year ago after having my employment terminated when I asked for a leave of absence. She reviewed the evidence and did not feel a lawsuit was appropriate but referred me to another attorney for a second opinion. I contacted her again after an offer of informal mediation from the DFEH and she coached me on how to respond. She did a lot of work for me for no money. When the employer offered formal mediation through DFEH, she put together all the evidence and accompanied me through the mediation. Her expertise and calm demeanor allowed me to get through the mediation, a very stressful experience, with a successful outcome. Her fees were paid from the settlement money. I did not have to pay anything until the successful completion of the mediation. I would definitely recommend her to anyone with a discrimination or wrongful termination complaint.

Calming
Being wrongfully terminated, processing what occurred, and making the decision to move forward in the legal process and find a lawyer is a very frightening time. You can’t plan for it, you aren’t ready when you are wrongfully terminated. Finding Ms. Riggins and her agreeing to take my case was truly a blessing. She was strong and comforting. She made sure to cover all aspects and questions. There was never a time I felt lost or confused about what was happening. She kept me informed and prepared for the next steps. I honestly can’t thank her enough.

Incredible
I recently retained Christa on a wrongful termination case. This was a difficult and personally emotional case…From the first conversation, Christa was knowledgeable, thorough, compassionate and empathetic… I can’t recommend Christa highly enough. While I never want to go through a lawsuit again, Christa made the process painless and easy and there’s no one that I’d rather have at my side representing me through such a tough case. The settlement that she negotiated was more than I had expected and she did it all with the upmost professionalism and compassion.
